POLICIES & RIDER AGREEMENTS

Clear, transparent policies for adventure motorcycling across Gilgit-Baltistan and Khyber Pakhtunkhwa.

RIDER SAFETY, ASSUMPTION OF RISK & LIABILITY WAIVER

Motorcycle adventure travel involves inherent and potentially serious risks. By booking and participating in an expedition with The Scenic Mistake, each participant confirms that they have read, understood and voluntarily accepted the following terms.

1. Acknowledgment and Assumption of Risk

I understand that participation in a motorcycle expedition may involve serious risks, including but not limited to:

  • motorcycle crashes, collisions and falls;
  • poor, damaged, unpaved, wet, icy, sandy, rocky or otherwise hazardous road surfaces;
  • mechanical failure;
  • landslides, rockfalls, flooding and road closures;
  • changing or severe weather;
  • high altitude, altitude illness, dehydration, fatigue and exposure;
  • remote locations with limited medical facilities, rescue services or communications;
  • actions of other road users, pedestrians or animals;
  • delays, route changes and interruptions caused by weather, authorities, political conditions, natural events or other circumstances beyond the operator's control.

I understand that serious injury, permanent disability or death may result from motorcycle riding and adventure travel.

I voluntarily choose to participate and knowingly assume the ordinary and inherent risks associated with the expedition, whether foreseeable or unforeseeable.

2. Rider Experience, Licence & Fitness

I confirm that I possess the motorcycle riding experience and ability required for the expedition I have selected.

I am responsible for holding all legally required licences, permits and travel documents necessary to operate the motorcycle assigned to me.

I confirm that I am physically and mentally capable of participating in the expedition and will disclose before departure any medical condition, medication or other circumstance that could reasonably affect my ability to ride safely.

The Expedition Leader may prevent me from riding or continuing the expedition if, in their reasonable judgment, my riding ability, physical condition, behaviour or conduct creates an unacceptable safety risk.

3. Mandatory Protective Riding Gear

I understand that riding gear and helmets are not included unless expressly stated otherwise for a specific expedition.

I am responsible for bringing and using appropriate motorcycle protective equipment, including:

  • an approved motorcycle helmet;
  • protective motorcycle jacket;
  • protective riding trousers;
  • motorcycle gloves;
  • sturdy motorcycle boots providing appropriate ankle protection;
  • weather and cold-weather protection appropriate to the itinerary.

I agree to wear required protective equipment whenever instructed by the Expedition Leader.

The operator may refuse to allow me to ride if my protective equipment is considered materially inadequate or unsafe.

4. Motorcycle Use & Rider Responsibility

I accept responsibility for the motorcycle assigned to me while it is under my control.

I agree to:

  • operate the motorcycle safely, lawfully and responsibly;
  • follow safety briefings, route instructions and group-riding procedures;
  • immediately report accidents, damage or mechanical problems;
  • refrain from reckless riding, racing or deliberate misuse;
  • remain on approved routes unless otherwise instructed;
  • not permit another person to operate my assigned motorcycle without authorization;
  • not perform or arrange unauthorized repairs or modifications.

I understand that I may be financially responsible for motorcycle loss or damage resulting from my crash, negligence, reckless riding, misuse, unauthorized use or deliberate conduct, subject to the Motorcycle Damage Policy applicable to my expedition.

Where a refundable motorcycle damage deposit applies, the amount and conditions will be communicated before booking or departure.

Normal mechanical wear and ordinary wear consistent with responsible use will not be treated as rider-caused damage.

5. Alcohol, Drugs & Impairment

The Scenic Mistake operates a strict policy against riding while impaired.

I will not operate a motorcycle under the influence of alcohol, recreational drugs, illegal substances or medication that materially impairs my ability to ride safely.

The Expedition Leader may immediately prohibit me from riding if they reasonably believe I am impaired or unsafe.

Serious or repeated breaches may result in removal from the expedition without refund.

6. Expedition Leader Authority

I understand that the Expedition Leader has final operational authority concerning group safety.

For safety, weather, road, health or logistical reasons, the Expedition Leader may:

  • change the route or schedule;
  • cancel a riding section;
  • change accommodation or transport arrangements;
  • require a rider to use alternative transportation;
  • prevent a rider from continuing to ride;
  • remove a participant whose behaviour creates a serious risk to themselves, the group, staff, property or the public.

Reasonable safety or operational decisions made by the Expedition Leader do not create an automatic entitlement to compensation or refund.

7. Travel & Medical Insurance

I understand that I am responsible for obtaining appropriate travel and medical insurance for the full duration of my trip.

My policy should provide appropriate cover for the motorcycle activity and engine capacity involved and, where relevant, medical treatment, emergency evacuation and repatriation from remote or high-altitude areas.

I am responsible for confirming directly with my insurer that my policy is suitable for my expedition.

I will provide proof of required insurance before departure if requested.

Any medical, rescue, evacuation, repatriation or associated expenses not covered by my insurance remain my responsibility.

8. Medical Treatment & Emergency Decisions

If I become injured, ill or unable to make decisions during an emergency, I authorize the expedition team to take reasonable steps to obtain medical assistance, evacuation or transportation where circumstances permit.

I understand that medical and rescue services may be delayed, limited or unavailable in remote areas.

Any resulting expenses remain my responsibility except where applicable law requires otherwise.

9. Release and Limitation of Liability

To the fullest extent permitted by applicable law, I voluntarily release and discharge The Scenic Mistake, its owners, directors, employees, expedition leaders, guides, contractors, representatives and affiliated service providers from claims arising from the ordinary and inherent risks of my voluntary participation in the expedition.

To the fullest extent permitted by law, this release includes claims arising from ordinary negligence, but does not exclude or limit any liability that cannot lawfully be excluded under applicable law.

I understand that motorcycle adventure travel cannot be made completely risk-free and that my decision to participate is voluntary.

This agreement is intended to bind me and, where legally permitted, my heirs, estate, executors, administrators and legal representatives.

10. Participant Responsibility & Indemnity

I accept responsibility for loss, damage, injury, fines, penalties or third-party claims arising directly from my unlawful, reckless, deliberately harmful or materially negligent conduct.

To the extent permitted by law, I agree to reimburse or indemnify The Scenic Mistake for reasonable losses or expenses arising directly from such conduct where those amounts are not otherwise recoverable.

11. Third-Party Service Providers

Hotels, airlines, transport providers, motorcycle suppliers and other independent service providers may provide parts of the expedition.

To the extent permitted by applicable law, The Scenic Mistake is not responsible for acts or omissions of independent third-party providers that are outside its reasonable control.

Nothing in this clause excludes responsibility that cannot legally be excluded.

12. Route Changes & Conditions Beyond Our Control

Adventure itineraries are inherently flexible.

Weather, landslides, road closures, flight disruptions, government action, security conditions, natural disasters or similar circumstances may require significant changes.

The Scenic Mistake may modify routes, schedules, accommodation, transport or activities where reasonably necessary for safety or operational reasons.

Where possible, reasonable alternative arrangements will be made, but identical routes, services or accommodation cannot be guaranteed.

Cancellation and refund rights remain governed by the applicable Cancellation & Refund Policy.

13. Personal Property

I am responsible for my passport, money, luggage, riding equipment, electronics and other personal property.

The Scenic Mistake is not responsible for ordinary loss, theft or damage to personal belongings except to the extent liability arises under applicable law.

14. Photo & Media Consent — Optional

Photographs and video may be taken during the expedition.

My image may only be used for promotional, editorial or commercial purposes where I have provided the applicable consent.

Participants who do not wish to provide such consent may opt out in writing.

15. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Pakistan.

To the fullest extent permitted by applicable law, any dispute, claim or proceeding arising out of or in connection with this Agreement, the expedition, or the participant's booking shall be subject to the jurisdiction of the courts of competent jurisdiction in Pakistan, subject to any mandatory consumer-protection rights that apply.

16. Severability

If any provision of this waiver is found invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

17. Confirmation & Acceptance

By signing this waiver and participating in the expedition, I confirm that:

  • I have read this document carefully;
  • I understand its contents;
  • I have had the opportunity to ask questions before participating;
  • I understand the risks associated with motorcycle adventure travel;
  • I accept these terms voluntarily;
  • I understand that this document affects my legal rights.

Please download the waiver, read it carefully, complete the required details, sign it, and return the signed copy to The Scenic Mistake before your expedition.

A signed waiver is required from every rider before participation. Booking an expedition does not replace the requirement to complete and sign this document.
